As you are aware, the second part of the Closing Loopholes amendments to the Fair Work Act have now passed into law, bringing several further changes to employment law. These have different commencement dates, with many commencing in July and August 2024. 

Changes coming into effect between June and August 2024 

  • 1 July 2024 the criminal offence of industrial manslaughter is added to the Federal Work Health and Safety Act;
  •  1 July 2024 new rights for workplace delegates were inserted into all Modern Awards and all new Enterprise Agreements from 1 July 2024 must include a similar delegates’ rights term. Refer to the Fair Work Commission’s website.
  • 26 August 2024 new definitions of employer and employee;
  • 26 August 2024 changes to standards and protections for ‘gig economy workers;
  • 26 August 2024 changes to casual employment including the new definition of a casual employee; and 
  • 26 August 2026 the right to disconnect commences.
